Help & FAQ

1. Q. What kind of cases does your firm handle?

A. At the San Diego Immigration Law Center, we handle a variety of immigration cases, from deportation and removal defense to non-immigrant and investment visas.

2. Q. I want to Immigrate to the U.S., what is the first thing I should do to learn how?

A. You should first consult with an experienced immigration lawyer. We find that most clients coming to our office have been given incorrect information about immigration to the U.S. At San Diego Immigration Law Center, our lawyers carefully listen to the history of your case, ask you important questions, and then offer you personalized solutions and the best ways of immigrating to the U.S. Each individual is different and so is his/her immigration case.

3. Q. Is it true that I can immigrate through Marriage and Fiancé Visas?

A. Yes! But, only after careful screening of your case. In some cases a fiancé visa is appropriate. But in most cases an immigrant visa through marriage to a U.S. citizen is more appropriate. A few years ago, coming to the U.S. via a fiancé visa was faster. Currently, coming to the U.S. via marriage to a U.S. citizen or being engaged to a citizen fiancé takes about the same time. It is important to correctly file all of the necessary immigration documents to obtain a marriage visa or lawful permanent residence. Adjustment of status: You must file for adjustment of status (green card) prior to the expiration of your current visa. Failing to do so could lead to deportation.

4. Q. I am now in Removal / Deportation/ Bond proceedings what should I do?

A. If you or your loved one was arrested, you may be facing deportation. Deportation or Removal is often a complex process. Your will have to appear before a federal immigration judge to answer to the allegations/charges filed against you and explain why you should not be deported. Immigration and Custom Enforcement will have one of their lawyers in court to convince the judge that you should be deported. You will need an experienced lawyer on your corner to defend you and help you stay in the U.S.. San Diego Immigration Law Center works with clients nationwide to help them out of custody (bond out) and defend them against removal / deportation.

5. Q. Can I get a Work Visa?

A. In the United States, there are numerous types of work visas available. Applying for the right visa is crucial. For each visa complex paperwork and documentation is required and the whole process can be frustrating. The San Diego Immigration Law Center can assist you in obtaining a work visa.

6. Q. Can I get a Green Card through Work in the U.S.?

A. Yes! Both you and the U.S. employer must qualify. You need to have the right education or job experience and the employer needs to have the right job. We can then file to obtain a non immigrant visa and then a green card for you. The process may take from a few months to few years. You or your family members in the U.S. must find the right job. As immigration Attorneys we only handle the immigration paperwork part for you and can not find a job for you.

7. Q. I have heard that I can get a green card if I invest only $500,000.00 in the U.S. is this true?

A. Yes! The require investment is $1000, 000.00 in a U.S. business that can directly create 10 jobs. For certain economically challenged areas this investment is only $500,000.00 in a business that either directly or indirectly creates 10 jobs. This process is also very complicated and there are many investment scams. Investors may lose their entire investment if they do not select their lawyer and their investment carefully. The San Diego Immigration Law Center recommends that investors get a visitor visa and come to the U.S. While in the U.S., they can consults with experts and select the right business to invest in. Our firm does not give investment advice to its clients and considers it a conflict of interest. We will provide you a list of Immigration approved investments you can research and select from. After you have selected your investment, we can take care of your paperwork.

8. Q. Can I send money to U.S. from Iran to invest in the U.S.?

A. Yes! But the process is very complex. Under the current laws, we will need first to obtain two permits from a special U.S. government office called OFAC. One for you to be able to pay our legal fees and the other for you to be able to bring your investment money here for your investment green card.
