INVESTMENT VISAS- EB-5


This visa provides a method of obtaining a GREEN CARD for foreign nationals who invest money in the United States. To obtain an Investment Visa, individuals must invest at least $500,000 creating at least 10 direct or indirect jobs. Investors can have a passive investment by investing in certain regional centers with high unemployment rates. The Immigrant Investor, the spouse, and the investor’s children who are under 21 years old first receive CONDITIONAL RESIDENCE (GREEN CARDS). After two years they must remove the condition by proving that the investment has been made, still exists, and continues to create 10 jobs. Investor can sell the investment after removing the conditional residency.

Investors must be very careful selecting the right investment so that their assets are secured and they can receive their green cards through their selected investment. Our Investment Visa attorneys recommend that the investor first visit the U.S. to learn about the investment options and to consult financial and investment experts before making an investment. It will be a risky venture if the investor tries to understand the process or invest in a regional center while they are overseas. Our offices recommend that the investor first obtain a visitor visa to come to visit the U.S. to meet with our lawyers and to look at various projects.

The E-2 Investor Visa allows an individual who is a citizen of a treaty country to enter and work inside of the United States based on an investment he or she will make inside the United States. This visa must be renewed every two years and there is no limit as to how many times one can renew. Investment must be substantial. An investor must contribute to the US economy. Setting up a small shop alone is not enough. The dollar amount of cash investment normally should exceed $100,000, depending on the type of business. However, based on the current economy and the rate of inflation an investment of at least $200,000.00 may be more realistic. This is an approximated amount and applicants should consult with our experienced immigration lawyers prior to making any offers for existing business. Applicants must also prove that the money has been obtained through legal means.

Upon conclusion of the business, E-2 investors must return to their countries of origin, or change to another status or obtain a green card through a family member, through employment, or by investing another additional $500,000.00 or $1000, 000.00 investments to obtain an EB-5 investor visa in San Diego. Spouse of the E-2 holder and unmarried children under 21 years of age, regardless of nationality, may receive derivative E-2 visas and can accompany the E-2 Visa holder. The spouse of the E-2 visa holder can apply for a work permit.
